The paper considers the acquired competence of the European Union in the field of foreign investments and it imposes a change in the existing system for settlement of disputes between investors and states. This paper focuses on the problems which are revealed by the existing mechanisms and how they might be overcome by creating a new judicial investment system of dispute settlement.
